EXISTEN DOS CONDICIONES GENERALES, LEA LA QUE CORRESPONDA. / THERE ARE TWO GENERAL CONDITIONS, READ THE APPLICABLE ONE.

 

A. CONDICIONES GENERALES PARA EL CAMPUS DE VERANO BERNIER / GENERAL CONDITIONS FOR THE BERNIER SUMMER CAMPUS

  1. PLAZAS: Las plazas son limitadas y se adjudican por estricto orden de reservas. CAMPUS DE VERANO BERNIER se reserva el derecho de suspensión, con TRES DÍAS de antelación, los servicios por no alcanzar el número mínimo de plazas o circunstancias adversas, en cuyo caso se devolverá el importe correspondiente y proporcional de las cantidades abonadas, sin contemplar indemnización alguna.
  2. EDADES DE LOS/AS PARTICIPANTES: podrán participar en el CAMPUS DE VERANO BERNIER aquellos/as niños/as con edades comprendidas entre los 4 y 16 años. Se podrá pedir documentación adicional para certificar datos.        
  3. HORARIOS: la recogida de participantes se efectuará en el horario establecido. El retraso puntual en la recogida supondrá un coste de 5€ por participante y fracción de 5 minutos. EL RETRASO REITERADO (más de TRES DÍAS) causará la baja del servicio, devolviéndose el importe correspondiente y proporcional al periodo no utilizado. En caso de no recogida se procederá a activar el protocolo según normativa vigente, informando a las Autoridades Competentes.           
  4. MODIFICACIÓN DE PERIODOS CONTRATADOS: Para realizar cualquier modificación del periodo y/o servicio contratado en esta inscripción, ha de realizarse por escrito, enviando un correo electrónico a campusbernier@gmail.com, con DIEZ DÍAS DE ANTELACIÓN. En ningún caso se aceptarán cambios una vez comenzados los servicios o periodos contratados.        
  5. BAJA: La baja o anulación de los servicios contratados en esta inscripción se formalizará por escrito, enviando un correo a campusbernier@gmail.com, con DIEZ DÍAS de antelación a los servicios contratados. En caso de no realizar dicho trámite dentro del plazo y forma indicados, el hecho de no hacer uso de los servicios no supone la baja, por lo que se le reclamarán las cantidades correspondientes y/o no serán susceptibles de devolución, en caso de haber realizado el abono. Una vez se haya realizado todo el trámite de inscripción, si se realiza la CANCELACIÓN COMPLETA, en plazo y forma, sólo se abonarán los servicios contratados y pagados, pero no se devolverán 10€ del importe abonado en concepto de gastos de gestión (no incluidos los gastos bancarios por devolución en cuentas de entidades bancarias distintas a la de la cuenta de abono (5€)). Una vez iniciado el servicio que regula la inscripción, el abandono por CUALQUIER MOTIVO, salvo causas de fuerza mayor (incendio, catástrofe, terremoto, ingreso hospitalario de larga duración…) no se devolverán las cantidades abonadas, ni total ni parcialmente.       
  6. ABONO DE LOS SERVICIOS REFLEJADOS EN ESTA INSCRIPCIÓN: Le será reclamado el importe de los servicios contratados en esta inscripción y aquellos informados por los medios habilitados para modificaciones. En caso de no cumplirse con la forma, cantidad y calendario de pago no se permitirá el acceso al servicio y a ningún otro que CAMPUS DE VERANO BERNIER gestione. Esta reclamación se hace efectiva a quienes, aun no habiendo utilizado los servicios, no hayan formalizado la baja según procedimiento reflejado en el punto anterior.           
  7. DEVOLUCIONES: El importe abonado en concepto de inscripción (cuando proceda) NO ES SUSCEPTIBLE DE DEVOLUCIÓN en cualquier caso, y para el resto de abonos realizados, tan sólo se contemplarán devoluciones por ausencias de larga duración (más de diez días) provocadas por enfermedad (justificante médico) o aquellas bajas comunicadas en plazo y forma (nº 5). NO SE CONTEMPLAN REDUCCIONES DE PRECIO POR FALTAS DE ASISTENCIA. En caso de realizarse devolución se realizará, como norma general, por transferencia bancaria, descontándose 5 € por gastos de gestión bancaria si la entidad de abono es distinta a la que se hizo el pago.
  8. NECESIDADES PARTICULARES: Es IMPRESCINDIBLE comunicar las necesidades educativas especiales. Cada caso estudiará de forma personalizada. 
  9. CAMPUS DE VERANO BERNIER: se reserva el derecho de dar de baja la inscripción por omisión o falsedad en los datos solicitados en este formulario, en cuyo caso no procederá devolución.     
  10. CAMPUS DE VERANO BERNIER: se reserva el derecho de dar de baja a los/as participantes por incumplimiento de las normas de funcionamiento y comportamiento del servicio.
  11. CAMPUS DE VERANO BERNIER y SU PERSONAL NO SE HACEN RESPONSABLES DE LA PÉRDIDA, ROBO Y/O ROTURA DE LOS JUGUETES, OBJETOS DE VALOR Y/O DINERO QUE TRAIGAN LOS/AS PARTICIPANTES. En ningún caso el personal de CAMPUS DE VERANO BERNIER se hará cargo de la guardia y custodia de los elementos anteriormente mencionados.
  12. CAMPUS DE VERANO BERNIER y SU PERSONAL NO SE HACEN RESPONSABLES DE LA PÉRDIDA, ROBO Y/O ROTURA DE MATERIAL ORTOPÉDICOS (audífonos, gafas,…)
  13. CAMPUS DE VERANO BERNIER, COMO NORMA GENERAL, NO ADMINISTRARÁ NINGÚN MEDICAMENTO A LOS/AS PARTICIPANTES. Para excepciones consultar.
  14. GESTIÓN ADMINISTRATIVA DEL SERVICIO: Sólo se reconocerá a nivel administrativo para la gestión del servicio a la/s personas firmantes en esta inscripción, emitiéndose: modificaciones, bajas, petición de certificados, petición de facturas.
  15. PROTOCOLOS DE CUSTODIA o TUTELA: Atendiendo al bienestar de los/as menores y siguiendo estrictamente la legislación al respecto, salvo que haya sentencias y/o medidas judiciales (debidamente justificadas) se entenderán como responsables a efectos de custodia y tutela a ambos tutores legales. Tanto CAMPUS DE VERANO BERNIER como su personal se limitará a cumplir la normativa vigente a ese respecto, evitando en todo momento posicionarse en posibles conflictos. En caso de peticiones fuera de estos límites se procederá a dar de baja en el servicio.
  16. GESTIÓN DE DATOS: ACTIVONIC SL, con domicilio en calle Virtud 34 CP 41010 Sevilla, con CIF B90483876 y correo electrónico campusbernier@gmail.com, trata sus datos personales con el fin de prestarle el servicio solicitado consistente en actividades deportivas de verano y animación. Tales datos se conservarán durante el periodo necesario según normativa vigente. Usted tiene derecho a obtener confirmación sobre si desde ACTIVONIC SL se están tratando sus datos personales y, por tanto, tiene derecho a acceder a sus datos personales, rectificar los datos inexactos o solicitar su supresión cuando estos no sean necesarios. Así mismo, Mediante la siguiente inscripción autoriza a ACTIVONIC SL a ceder los datos exigidos desde el centro donde se realiza el servicio, en caso de no estar de acuerdo NO PODREMOS PRESTARLE EL SERVICIO.
  17. CAMPUS DE VERANO BERNIER atenderá todas las reclamaciones sugeridas.
  18. ACEPTACIÓN DE LAS CONDICIONES: La realización de esta inscripción, firma y  entrega (formato digital o analógico) conlleva el PLENO CONOCIMIENTO Y ACEPTACIÓN DE LAS CONDICIONES GENERALES Y PARTICULARES establecidas en esta inscripción.
  19. AUTORIZACIÓN PARTICIPACIÓN: Con la inscripción y/o firma de este formulario/documento AUTORIZO A MI HIJO/A a participar en los servicios y actividades objeto de esta inscripción.

B. GENERAL BOOKING TERMS AND CONDITIONS (only for VIVA ACTIVE padel holiday programs) / TÉRMINOS Y CONDICIONES GENERALES DE RESERVA ( solo para programas de vacaciones de padel VIVA ACTIVE)

By requesting, making, or paying for a reservation for any of the programs offered by Activonic SL, either through its website or directly with Activonic SL, you declare that you accept the general terms and conditions for reservations, payment deadlines, and cancellations. If the reservation, part of a reservation, or an additional service is made or contracted through an external agent (intermediary, operator, or travel agency not affiliated with Activonic SL), you also declare that you accept the general terms and conditions of reservations established by the external agent, thereby exempting Activonic SL from any liability related to the portion of the reservation arranged through the external agent.

GENERAL RESERVATION CONDITIONS

A reservation will be considered a full right of the client provided the following three conditions are met:

  1. Full Payment: The full reservation amount has been paid, which includes the program price as listed on the website or any other medium, plus additional services not included in the program price, such as extra nights, flights, or other additional services requested by the client. Payment methods will be provided as deemed appropriate at the time.
  2. Compliance with Payment Deadlines: The client adheres to the established payment deadlines.
  3. Reservation Confirmation: Activonic SL explicitly confirms the acceptance of the reservation through any available communication channel (email, phone call, etc.).

Even if the reservation payment has been made, it will remain subject to the confirmation of availability at associated establishments such as hotels or other facilities. Activonic SL will verify availability with providers and notify the client as soon as final confirmation is obtained.

If availability cannot be guaranteed, the client will be promptly informed and offered alternatives or, if necessary, a refund of the amount paid.

Activonic SL reserves the right to cancel a reservation if the client fails to meet payment deadlines or general cancellation conditions.

If a program cannot be carried out, either partially or fully, due to reasons attributable to Activonic SL, a refund corresponding to the unused portion of the program will be provided (up to the total program price or the amount paid at the time).

Adverse weather conditions preventing the program from taking place are not considered grounds for cancellation or non-performance attributable to Activonic SL.

Failure to participate in the sports activities program for reasons attributable to the client—whether or not they stay at the hotel or travel to the program destination—will not warrant a partial or total refund of the reservation amount.

RESERVATION PAYMENT DEADLINES

The full reservation amount must be paid either at the time of booking or within the following timeframes:

  • More than 55 calendar days before the program start date: The full reservation amount must be paid within 10 calendar days from the booking date.
  • 54 calendar days or less before the program start date: The full reservation amount must be paid within 3 business days from the booking date.
  • In all cases: The full reservation amount must be paid before the program start date.
  • Special Offers: Payments must comply with the specific conditions outlined for the special offer.

Only compliance with these deadlines and general reservation conditions will guarantee the reserved slots.

If the full reservation amount is not paid within the specified deadlines, Activonic SL reserves the right to cancel the reservation and replace it with another within the same program. In such cases, the general cancellation conditions will apply.

GENERAL CANCELLATION CONDITIONS

Clients may only cancel a booked and/or paid program by written communication to info@vivaactivetravel.com. In such cases, the following cancellation fees will apply:

  • Up to 45 calendar days before the program start date: €29 administrative fee per reservation.
  • Between 44 and 22 calendar days before the program start date: 25% of the total amount (program + additional services) per person.
  • Between 21 and 11 calendar days before the program start date: 50% of the total amount (program + additional services) per person.
  • Within 10 calendar days of the program start date: 100% of the total reservation amount (program + additional services) per person.

For special offers, specific cancellation conditions will apply.

CANCELLATION GUARANTEE

Clients have the option to purchase a cancellation guarantee for their reservation, entitling them to a full refund of the reservation amount (excluding the €29 administrative fee) up to 48 hours before the program start date without needing to provide a reason.

  • Cost: €70 per reservation per person.
  • Payment Timing: The cancellation guarantee must be purchased at the time of booking or, at the latest, before the reservation is confirmed by Activonic SL.
  • Validity: The cancellation guarantee becomes invalid at 00:00 two days before the program start date.

This guarantee can be purchased through the website during the booking process or by requesting it directly from Activonic SL through the designated contact channels.
